<p style="text-align: left;">Mac aficionados that also enjoy a pack of Marlboros every now and then might want to keep their smoke as far away from their computer as possible for it appears Apple doesn&#8217;t take kindly to the habit. Yesterday, Consumerist ran a story about two customers that were denied warranty repairs to their MacBook and iMac by Apple (both had purchased extended AppleCare warranties) simply because the machines were exposed to second-hand smoke. Both appealed to the office of Steve Jobs to no avail. The strangest thing, however, is the explaination that one received from someone at Jobs&#8217; office: the nicotine released from cigarettes is classified as a bio-hazard by the Operational Safety and Health Administration (OSHA) and as such, Apple employees are within their rights to refuse to work on a machine that has been in contact with the chemical. The only suggestion Apple offered was to take the computers to be fixed somewhere else on their dime. Obviously these two cases are an anomaly, but the question still remains: should Apple be able to walk away from its obligation as set out in the AppleCare agreement because of a little bit of smoke? Just to be clear, there is nothing in the AppleCare fine print that even comes close to singling out smoking as being prohibited.<span id="more-39213"></span></p>

The reason for this isn&#8217;t greed (well, it is, sort of) but because Bell made like Rogers and TELUS and killed off the much maligned $6.95 per month System Access Fee (SAF) and E911 fee meaning that subscribers of the new plans will have an extra $2.70 in their pocket each month. The first of the Big Three to drop the SAF was Rogers, who on October 5th raised the prices of its voice plans by $5 and replaced the SAF and E911 fee with the <a href="http://www.boygeniusreport.com/2009/09/22/rogers-to-kill-the-saf-sort-of/">Government Regulatory Recovery Fee</a> (GRRF). The GRRF ranges from $2.58 to $3.11 depending upon the province once resides in. One month later on November 5th, TELUS officially dropped the SAF when it introduced its Clear Choice plans. Again, each plan was increased by $5, but there are no gimmicky fees meaning that TELUS customers on the new plans are paying $2 to $3 less per month. Those who are on the old plans are under no pressure to switch to the new, SAF-free plans.<span id="more-39194"></span></p>

<p>Sony Ericsson has us scratching our heads just one day after we spent some time with its new <a href="http://www.boygeniusreport.com/2009/11/18/sony-ericsson-xperia-x10-hands-on/">XPERIA X10 smartphone</a>. During our lunch meet-up, SE told us it was hoping to work with U.S. carriers in getting the X10 into the pockets of Americans on the cheap. We&#8217;re still hoping that SE will make this happen, but a new rumor would see the X10 retail for a whopping $879 when it hits the market during the first quarter of 2010. We know that SE is hoping to get back on the relevance map and turn a profit while it&#8217;s at it, but a sky-high price tag on a device that failed to knock our socks off probably isn&#8217;t going to cut it with consumers.</p>

<p>It looks like Verizon has finally figured out what it&#8217;s going to do with the Alltel employees that it picked up during its acquisition of the company: give them the axe. More specifically, Verizon is cutting an unspecified number of jobs in Little Rock because those corporate positions are now redundant. The departments being given the axe include finance, marketing and legal, but there is some hope for those losing their jobs &#8212; Verizon would be more than happy to have them apply for positions in its call centers. We&#8217;re not sure if being asked to step down from finance to handle customer complaints over the phone is a nice offer, but having a job is better than no job, right?<span id="more-39081"></span>

<p>The US isn&#8217;t the only country to have its two largest wireless carriers in the middle of a <a href="http://www.boygeniusreport.com/2009/11/18/at-launches-its-own-attack-ads/">legal spat</a> as Canada&#8217;s TELUS has filed suit against Rogers Wireless. The reason for the lawsuit has to do with Rogers&#8217; claim to &#8220;Canada&#8217;s most reliable network&#8221;, one that is &#8220;two times faster than any other.&#8221; According to TELUS, such claims became invalid as of November 5th when its very own 21Mbps HSPA network was launched. Looking to resolve the matter out of court, the Burnaby, BC-based company asked Rogers to immediately cease all reliability and speed claims. Rogers did not and one week later the lawsuit was born. </p>
<p>As it stands today, Rogers is refusing to back down from its claims citing independent studies dating back to 2007 which consistently show its networks superior performance. The problem with the position taken by Rogers is it puts TELUS at an unfair disadvantage as its new network has yet to undergo such third-party testing. On the other hand, the Rogers network does include an EDGE network, something TELUS does not have, which one could argue creates a fail-safe of sorts thus lending credence Rogers&#8217; claimed reliability. As for what it hopes to achieve with the lawsuit, TELUS is asking that Rogers admit it disregarded the standards set forth in the Competition Act, stop all ads claiming its network to be the fastest and most reliable and, as always, pay for damages incurred.</p>
<p>Bell, who shares its network with TELUS, is not involved in the lawsuit.</p>

<p style="text-align: left;">Earlier today in Atlanta, Judge Timothy Batten, Sr. ruled against AT&amp;T in its hunt for an injunction against Verizon&#8217;s &#8220;There&#8217;s A Map for That&#8221; ad campaign. While AT&amp;T argued that the maps in the commercial were <a href="http://www.boygeniusreport.com/2009/11/13/att-sets-the-record-straight-in-response-to-verizon-attack-ads/">grossly misleading</a>, Judge Batten felt that although&#8221;sneaky&#8221;, the fact that the ads could be “misunderstand&#8221; by the layperson doesn&#8217;t mean that they were &#8220;misleading.&#8221; The case isn&#8217;t completely closed, however, as AT&amp;T has been granted a hearing on December 16th in which it&#8217;s lawyers will argue for the judgement to be repealed. In the meantime, AT&amp;T has launched a rather feisty ad campaign of its own called &#8220;The Truth About 3G&#8221;. The ad campaign kicked off tonight with a TV spot starring Luke Wilson who espouses the advantages offered by AT&amp;T: speed, the best smartphone selection, simultaneous voice and data and the over 100,000 applications. We have the first ad waiting for you after the jump, but first we have to ask &#8212; does anyone have any <span style="text-decoration: line-through;">non-flaming</span> thoughts on this matter?</p>

Naturally, we&#8217;ll keep you updated as we receive more news, but for now we&#8217;re not quite sure what&#8217;s causing this outage as it seems to be possibly affecting BlackBerry users on a global scale and we have numbers of around 75-80% in terms of users affected. <p style="text-align: left;">While Canadian carrier hopeful WIND might not be launching any time soon thanks to its <a href="http://www.boygeniusreport.com/2009/10/30/canadas-crtc-takes-the-air-out-of-winds-launch/">foreign ownership structure</a>, outsiders are already drooling at the prospect of buying up all of WIND&#8217;s spectrum in the event that it doesn&#8217;t launch. WIND CEO Ken Campbell dismissed such things as &#8220;media speculation&#8221; <a href="http://www.boygeniusreport.com/2009/10/31/bgr-sits-down-with-wind-ceo-ken-campbell/">during our interview</a> with him and repeated ad nauseam that WIND is currently weighing its options, but now more of its would be competitors are speaking up on what might be. Said Rogers CEO Nadir Mohamed on Friday: “Spectrum is a very valuable asset. Rogers for sure would be interested in picking it up.” Snapping up all of WIND&#8217;s spectrum wouldn&#8217;t be cheap considering it was originally purchased from Industry Canada in 2008 at a cost of $442.1 million Canadian ($420.4 million USD), but the possibility that several of the Big Three would buy it in parcels if the launch never happens remains relatively high. After all, Bell has previously said it would be willing to purchase half of WIND&#8217;s spectrum at $0.50 on the dollar.<br />

<p>Many of you have been on the edge of your seats and sofas waiting for anxiously for the BlackBerry 9700 to drop. We already know it&#8217;s being released on November 16 on T-Mobile, but now you have a killer incentive to pick one up from Walmart. From November 14th to the 20th, Walmart is offering a $100 Walmart gift card with a new BlackBerry purchase &#8212; the only thing is it takes four to six weeks to get that card in the mail. It&#8217;s not exactly the same as getting a new BlackBerry 9700 for $99.99, but it&#8217;s as close as you&#8217;re going to get for now. And just imagine what you can get at good old Wally World with a $100 gift card just before the holidays. The usual bells and whistles apply with the two-year contract business, but that comes with the territory. Is it safe to assume that T-Mobile corporate stores will be hearing crickets on launch day? Who are we kidding&#8230; this is probably the most anticipated device for T-Mobile in years.</p>

<p>We&#8217;ve all seen the <a href="http://www.boygeniusreport.com/2009/11/08/verizon-gets-into-the-christmas-spirit-by-bashing-att-and-the-iphone/">Verizon ads that make fun of AT&amp;T&#8217;s network</a> and the iPhone, and while it makes for a good chuckle, the folks at AT&amp;T aren&#8217;t laughing. As a matter of fact, as you know, a lawsuit has been brought against Verizon to cease the airing of the ads. While the two rage on and settle the legal matter, AT&amp;T has decided to take things into its own hands by publicly responding to the Verizon ad on its own site. <li><span style="text-decoration: underline;">EDGE.</span> 301 million people or more than 96% of the population are covered by EDGE. With both 3G and EDGE coverage, customers can access the Internet, send e-mail, surf the Web, stream music, download videos, send photos, text, talk and more. The only difference – with some data applications, 3G is faster than EDGE

<p>AT&amp;T is also dipping its finger into Verizon&#8217;s drink by stating that the latter can&#8217;t do data and voice at the same time, and its smartphone collection is nowhere near as popular as AT&amp;T&#8217;s smartphone lineup (read: iPhone). We had already known that T-Mobile was planning on lighting up its 7.2Mbps speeds in some cities by the end of 2009, but it looks like HSPA+ is kicking in just months later. Slated for mid-2010, a number of U.S. markets will have data speeds of up to 21Mbps on T-Mobile&#8217;s network. There are also a decent amount of handsets that will be able to take advantage of the 7.2Mbps kick, like the G1, CLIQ and the myTouch 3G, but we&#8217;re really looking for what T-Mobile has in store for the masses once HSPA+ hits. In addition to the speed upgrades, the company is also continuing to spread its 3G footprint across the country. Now where are those <a href="http://www.boygeniusreport.com/2009/11/10/nokias-n900-gets-its-marching-orders/">Nokia N900s</a> with AWS 3G support?<span id="more-38572"></span></p>

<p style="text-align: left;">Here&#8217;s a bit of an odd one. The iPhone has been on sale in the UK since November 2007 when O2 began exclusively offering the original iPhone. But it was only today the record for single day sales for a sole handset was shattered as <a href="http://www.boygeniusreport.com/2009/09/28/orange-uk-announces-it-too-will-be-carrying-the-iphone-this-year/">Orange began selling</a> the iPhone 3G and iPhone 3GS. The specific number sold has yet to come out as the day is not yet done, but as of 4pm local time, nationwide sales surpassed 30,000 units. Why is this? Orange thinks it is all to do with its network which it says offers far greater coverage and reach than its competitors and is the focus of a new multi-million pound ad campaign entitled &#8220;You&#8217;re Covered,&#8221; as well as its Orange Wednesdays app which offers perks like 2-for-1 movie coupons. Of course we&#8217;re still <a href="http://www.boygeniusreport.com/2009/09/29/vodafone-to-get-the-iphone-in-the-uk-and-ireland/">waiting for Vodafone</a> to start selling the iPhone as it announced it would in September, so we&#8217;re quite interested to see how long this record last. One more thing for UK iPhone users. As of today, O2 will legitimately unlock your phone provided that you adhere to the following conditions: Pay Monthly users can unlock at any time but must continue to pay until O2 for services until their term is up while Pay Go subs must have had their iPhone for 12 months and pay a £15 fee. The In addition to this, Google has set up a way for travelers at each airport to donate to charities Engineers Without Borders, the One Economy Corporation and Climate Savers Computing Initiative. Google will match each airports donations up to $250,000 and will also give the most generous airport $15,000 for the charity of its choosing.</p>

<p>If there is a company that wants to jump into the netbook market and offer something unique and solid, it would be HTC. It has already produced some rock-solid handsets like the Hero, Eris, Touch Pro2 and HD2, so why not a netbook? HTC CEO Peter Chou mentioned that his company is still very much interested in building a netbook. We think that Mr. Chou may be onto something with the idea that HTC should put out something unique and not just another &#8220;me too&#8221; netbook. After all, it seems like the entire netbook market is one giant clone army. With the <a href="http://www.boygeniusreport.com/2009/10/02/nokia-booklet-3g-reportedly-hits-best-buy-inventory-system-at-599-99/">Nokia Booklet 3G</a> coming very soon, HTC is probably thinking that if one major handset manufacturer can pull it off, why not take a crack at it? As long as HTC doesn&#8217;t <a href="http://www.boygeniusreport.com/2008/03/25/htc-shift-cdma-review/">bomb like it did with the Shift</a>, we think it will be a hit.<span id="more-38396"></span>

This news in itself didn&#8217;t interest us in the least, but for giggles we clicked on through to Black&#8217;s website just to see what handsets it was going to be offering considering the odd partnership. What did we see in the line up? None other than a TELUS branded BlackBerry Storm2. Unfortunately what you see above is all we have for now as this sucker has not yet been announced by TELUS, but we have a feeling that will change very, very soon.</p>

<p style="text-align: left;">Here at BGR we love the underdog, so we are a little disappointed to have to tell you about the latest figures coming out of the T-Mobile camp. T-Mobile released their Q3 numbers today and suffered a net loss of 77,000 subscribers, with 140,000 customers packing up their number and shacking up with another carrier. Compare the loss with the 325,000 subscribers it gained in Q2 of this year or the 670,000 it gained in Q3 of last year, and, well ouch; it would appear as though T-Mo&#8217;s momentum might be slowing. The profits also shrunk a bit, in Q2 T-Mo posted a $425 million profit while in Q3 that number shrank to $417 million. So, will the new &#8220;<a href="http://www.boygeniusreport.com/2009/10/25/t-mobile-formally-announces-its-even-more-and-even-more-plus-plans/">Even More</a>&#8221; plans, Android handsets, and new BlackBerry smartphones be enough to get T-Mobile back on track for Q4? Or will the comparatively meek holiday lineup make for a flat Q4? Equipped with a 3&#8243; touchscreen display and 3.2 megapixel camera, the Chocolate Touch also features support for VZ Navigator, V CAST Music/Video, Visual Voicemail and EV-DO Rev. 0 connectivity. AT&amp;T feels Verizon is attempting to deliberately mislead the public with its map comparing Verizon&#8217;s nationwide 3G coverage to AT&amp;T&#8217;s limited 3G coverage. Granted all major cities and towns have AT&amp;T 3G, but AT&amp;T would really like Verizon to show its EDGE network, which according to AT&amp;T spans 1.75 million square miles and reaches 256 million people, a little bit of love on the map. As for when HSPA newcomers Bell and TELUS will be offering up the 9700, the latest word is that both carriers will offer the device the day they launch their new networks. For Bell, that&#8217;s the 4th of November with TELUS following the very next day.</p>

<p>Just a few days ago, <a href="http://www.boygeniusreport.com/2009/10/30/sprint-gears-up-for-more-android-blackberry-and-windows-mobile-goodness/">Sprint announced its plans</a> to release a ton of new and exciting handsets which included WiMax-capable devices. Our initial thoughts were, &#8220;Who&#8217;s gonna use these? And outside of a few cities, where is WiMax even available?&#8221; But it looks like Sprint has a plan and is sticking to it as Charlotte, Raleigh, Greensboro, Chicago, Dallas/Fort Worth and a few other cities are going to be lit up with 4G goodness.</p>
<p>Sprint says, &#8220;To use Sprint 4G service, all you will need is a 4G plan and the Sprint 3G/4G USB Modem U300. Just plug in the device and start downloading mammoth attachments, uploading huge files and video-conferencing with no lag.&#8221; In case you were wondering, WiMax hits max speeds of about 10Mbps, which is faster than what some people have wired at home, and averages between 3Mbps &#8211; 6Mbps. <p>It doesn&#8217;t get any better than being able to do stuff with your phone just by talking into it, and now Google is bringing that experience to Nokia S60 devices. For those of you with iPhones and BlackBerrys, you&#8217;re probably already pretty familiar with this feature available on the Google Mobile App. While it might not have as dominant a share in the U.S. as it does globally, Symbian devices are still number one worldwide. So, it only makes sense that this extremely convenient feature is added to the popular OS. After all, many S60 devices don&#8217;t have full QWERTY keyboards, so searching by manual input is still a pain in the rear. In addition to making its voice features available to S60, Google Mobile App now recognizes and supports Mandarin Chinese, which is the most spoken language in the world. <p>Motorola&#8217;s DROID might be the new darling of the Android world, but other manufacturers are still kicking about and pumping some great offerings. Yesterday Sprint pushed out one such device and that&#8217;s the Samsung Moment. It might not be benefiting from the insane amounts of hype that the DROID is enjoying, but it does have a 3.2&#8243; AMOLED touchscreen display, sliding QWERTY keypad, 3.2 megapixel camera, Wi-Fi, GPS, 256MB RAM and a speedy 800MHz processor running on top of Android 1.5. At $179.99 after a $100 MIR, the Moment comes in at $20 cheaper than the DROID, a price we can&#8217;t help but think Sprint is already considering slashing.</p>

<p>Back in July we fought back drool while watching a leaked video of the <a href="http://www.boygeniusreport.com/2009/07/08/new-images-of-sony-ericsson-rachael-and-kiki-surface-along-with-a-rachael-ui-video/">custom UI overlay</a> Sony Ericsson has prepared for the soon to be official <a href="http://www.boygeniusreport.com/2009/07/21/sony-ericsson-rachael-to-launch-as-xperia-x3-specs-revealed/">XPERIA X3</a>. Today, we&#8217;re repeating the process all over again as yet another UI video has surfaced, this time dealing specifically with the media player. Looking wonderfully polished, well thought out and seemingly liberally borrowing styling cues from Microsoft&#8217;s Zune HD, the overall hotness cannot be denied. Yes, indeed, we cannot wait to get some hands on time with the XPERIA X3 so we can pit it against Motorola&#8217;s DROID. Hit the jump to check out the video.</p>

The news of this came from a German blog which leaked a photo of a business guide (pic after the jump) as well as an official O2 device price list which shows the MILESTONE coming in at 404.20€ or $594.93 USD before taxes (and subsidies). If that isn&#8217;t proof enough, we pulled the image above from from O2&#8217;s site after a simple Google query. No doubt there will be some people Stateside that refuse to go over to Verizon to get the DROID (we get a huge kick out of network fanboyism), so how many of you would be willing to import one of these Android 2.0 behemoths even if it lacks US 3G?</p>

<p>A mere two days after its release, Android 2.0 SDK has already been ripped from the womb and ported over to a T-Mobile G1. Currently in the most crude state possible, the cooked ROM runs as quickly as Babe Ruth did at his heaviest (and drunkest).The mere fact it&#8217;s able to run without melting the G1 and its 192MB of RAM, though, should give hope that the fine folks over at XDA-Developers will be able iron out enough wrinkles to make it usable as a daily driver. The only question is will G1/Dream and myTouch 3G/Magic users be treated to some delicious Eclairs <a href="http://www.boygeniusreport.com/2009/10/29/htc-hero-to-get-android-2-0/">like Hero users</a>, or will they be stuck stuffing their faces with Donuts? <p>Back in August, Globalive, a big winner in Canada&#8217;s AWS auction, announced that it was going to <a href="http://www.boygeniusreport.com/2009/08/10/globalive-to-launch-canadian-wireless-services-as-wind/">launch its network</a> under the WIND brand and shake up the Canadian wireless industry. Now it looks as if this will not be happening &#8212; at least in the immediate future &#8212; as the Canadian Radio-television and Telecommunications Commission (CRTC) ruled yesterday that WIND does not meet the Canadian ownership rules. The rules, which are set out in the Telecommunications Act, stipulate that wireless carriers must be <a href="http://laws.justice.gc.ca/eng/T-3.4/page-2.html#anchorbo-ga:l_II-gb:s_16">majority owned and controlled</a> to the sum of 80% by Canadians. Because Orascom, an Egyptian company, owns 65.1% of the equity in WIND as well as the rights to the WIND brand in Canada, the CRTC ordered that WIND not launch its network until the company is fully compliant with the Act. Strangely enough, during last years wireless spectrum auction, Industry Canada ruled that WIND did indeed meet Canadian ownership laws as set out in the Telecommunications Act, but strong opposition from the existing major carriers &#8212; Bell, Rogers and TELUS, companies whose ownership meets complies with the Act &#8212; at a hearing on October 1st likely helped the ruling. So what does the future hold for WIND and its $442mm CAD ($413.8mm USD) worth of 1700MHz UMTS/HSPA spectrum? Nothing unless it manages to re-organize its board and find new investors.<span id="more-37709"></span><a href="http://www.theglobeandmail.com/report-on-business/globalive-fails-ownership-test-crtc/article1344210/">Read</a></p>

<p>Yesterday, Sprint executive David Owens dropped a ton of great news for Sprint customers in a live chat. Some of the news isn&#8217;t groundbreaking, but it&#8217;s still good to know and get confirmation from Sprint directly. Read on for the list of items that were mentioned.<span id="more-37681"></span></p>
<ul>
<li>Google Android OS updates are coming for the HTC Hero and Samsung Moment. While he didn&#8217;t specify a version &#8211; 1.6 or 2.0 &#8211; HTC has previously confirmed that they&#8217;re working on an Android 2.0 update for the Hero. </li>
<li>Combination CDMA/GSM Android phones are also &#8220;a possibility but nothing this year.&#8221;</li>
<li>They&#8217;re considering an Android phone with a built-in MiFi-type router.</li>
<li>Android phones will get less expensive &#8220;as we see volume across the industry.&#8221;</li>
<li>Lots of HTC and BlackBerry phones coming next year. HTC phones &#8220;will be on the Android platform.&#8221; </li>
<li>Sprint will &#8220;add Wi-Fi to [the BlackBerry] Tour&#8221; and have other Wi-Fi BlackBerry smartphones going forward.</li>
<li>They&#8217;re testing Windows Mobile 6.5 updates for the HTC Touch Pro2 and other Windows phones; &#8220;plan for early 2010.&#8221;</li>
<li>They want Windows Mobile 7.0 &#8220;as soon as possible, but dependent on Microsoft.&#8221;</li>
<li>Expect WiMAX phones next year.</li>
<li>No tethering for phones that require Everything plans (such as all smartphones) from here on out.</li>
</ul>
<p>We already know about the <a href="http://www.boygeniusreport.com/2009/10/29/htc-hero-to-get-android-2-0/">updates coming to the Hero</a> and Wi-Fi for the Tour, but it&#8217;s pretty cool to see that WiMAX phones are on the horizon. Hopefully that means a faster rollout of the 4G service. Owens also mentions more BlackBerry phones coming next year &#8212; could that mean that Sprint is also getting a <a href="http://www.boygeniusreport.com/2009/10/27/verizon-wireless-holiday-lineup-leaked-reveals-new-blackberry-curve2/">85xx series Curve just like Verizon</a>? It could be the Wi-Fi BlackBerry he&#8217;s talking about when &#8220;going forward.&#8221; Lastly, for travelers, having more CDMA/GSM world phones with Android is pretty good news, even if we have to wait until next year.</p>

After losing 801,000 post-paid subscribers, which is slightly better than the 870,000 that analysts expected, Sprint might need to really change its game to do more than just stay afloat. Consequently, Sprint&#8217;s losses for the quarter are a whopping $478 million compared to $326 million YoY. Revenue dropped about nine percent to $8.04 billion. Interestingly enough, Sprint&#8217;s prepaid service, Boost, added over 600,000 subscribers thanks to Boost&#8217;s $50 unlimited plan. But with its Simply Everything packages including <em>Any Mobile, Any Time</em>, and hardware like the Palm Pre and HTC Hero, Sprint could be looking to shrink its quarterly losses in the future and maybe even see some positive gain.</p>
