TELUS sues Rogers over network claims

The US isn’t the only country to have its two largest wireless carriers in the middle of a legal spat as Canada’s TELUS has filed suit against Rogers Wireless. The reason for the lawsuit has to do with Rogers’ claim to “Canada’s most reliable network”, one that is “two times faster than any other.” According to TELUS, such claims became invalid as of November 5th when its very own 21Mbps HSPA network was launched. Looking to resolve the matter out of court, the Burnaby, BC-based company asked Rogers to immediately cease all reliability and speed claims. Rogers did not and one week later the lawsuit was born.

As it stands today, Rogers is refusing to back down from its claims citing independent studies dating back to 2007 which consistently show its networks superior performance. The problem with the position taken by Rogers is it puts TELUS at an unfair disadvantage as its new network has yet to undergo such third-party testing. On the other hand, the Rogers network does include an EDGE network, something TELUS does not have, which one could argue creates a fail-safe of sorts thus lending credence Rogers’ claimed reliability. As for what it hopes to achieve with the lawsuit, TELUS is asking that Rogers admit it disregarded the standards set forth in the Competition Act, stop all ads claiming its network to be the fastest and most reliable and, as always, pay for damages incurred.

Bell, who shares its network with TELUS, is not involved in the lawsuit.

    Sorry, that was an honest mistake. Being from the evil land that is Ontario, I can’t speak for western or eastern canada’s coverage. However in Ontario, there’s really no difference, and arguing otherwise is pointless.

        There was a problem across Toronto (downtown mostly) with Rogers Wireless’ network. Specifically targeting the 3G+ network, connection and usage was pretty poor. When calling Rogers’ Tech Support, they blame it on the competitor’s network interfering with their own.

        But when I went to my trustworthy TELUS store, they encountered nothing of the such.

        I believe Rogers Wireless has a lawsuit waiting for them… Especially with the number of us playing big bucks for quality product. We’re being served nothing but garbage for the price of our data plans.

    There really isn’t much point comparing Bellus network to Rogers at this time. It will make more sense in a year or two.

    I’m just hoping Rogers gets a wake up call and gets it together…

      I dont understand this mentality. Of course there is a point. I want a phone TODAY Im going to compare the networks TODAY. And today Bell has the better network

    Its too bad Rogers footprint for Edge, which they do fall back on is so small in the western half of Canada.

    Looking at Telus/Bell New coverage map, you would be hard pressed to fall out of the 3G coverage.

    Looking at Rogers, it would take considerable effort to get on their HSPA an off of the Edge connection.

    lol Rogers.(Better start investing, an fast too.)

    The truth is TELUS and Bell caught Rogers with their pants down…Rogers expected Bell and TELUS to use the same approach they did…a slow roll out, but looks like the network guys and Bell and TELUS are pretty solid! Therefore, I think the lawsuit is justified…you can’t site 2007 data comparing it to a network that didn’t exist at that time.

    By the way you talk about bell seems like you work for them. I worked for all three and let me tell you something they all have advantages but in the end the only way you can say they are good is through your own personal experience. The new coverage for hspa for belus is impressive it’s similar to the CDMA coverage, the only disadvantage right now is their hspa handsets only work on 3g and currenly most of them don’t have good battery life.

      You’re right about the battery thing but thats just an HSPA+ issue which impacts everybody. The point about being just 3G is a moot one. If the 3G is reliable who cares if you cant fall back to 2G? And right now it doesnt seem to be an issue at all – so although the claim is theoretically valid, real life usage is not an issue

    Is your real life usage not in a city center though? In which case coverage is the same and you’re proving your point irrelevant. Outside of city is same. Shove the Pre and Storm, they’re garbage. Why would you use a Palm?? Way to have Android btw. Bell = Crap

    I just got a 9700, on the Bellus network, and (not using every feature, all day long. but still using wifi, BBM, and SMS frequently) can get two solid days usage out of my phone. Not bad, considering I was able to get 3 days at best from my previous CDMA device with only minimal calling and reasonable texting. In any case, the coverage I’ve seen from the HSPA+ network hasn’t failed me yet (except where the CDMA network has always had a dead spot) and so, I’m quite happy with it all. In short, I am VERY happy with my 3G+ coverage w/ Bellus, and think that Telus’ lawsuit stands very firm ground, with or without recent testing, as Rogers can no longer say that it definitely has the fastest network.

    Glad to be a Telus customer, and will be for years to come!

    (Flame on you Rogers fans, Flame on)
