Palin email hacker trial delayed by judge
David Kernell, the 20-year-old University of Tennessee student indicted for allegedly accessing Governer Palin’s email illegally, has been given a bit more time to enjoy fresh air before things potentially heat up. The son of Tennessee state Rep. Mike Kernell will not stand trial May 2009 when he is now scheduled to face one count of accessing a computer without authorization, a crime that carries up to five years in prison and a fine of up to $250,000. The reason for the delay according to a filing from the U.S. Attorney and the Department of Justice:
Because of the nature of this case, significant forensic evaluation is required [and] the parties agree that … an extension should be granted to allow counsel the reasonable time necessary for effective preparation.
Kernell and his lawyers are hardly upset by the judge’s decision to delay the trial of course, as it will give them plenty more time to attempt to have the case thrown out. Unlikely as it may seem, crazier things have happened. Barring some extraordinary legal eagling, the Kernall trial will begin on May 19, 2009.
He will get probation, fines and be forced to wash the judges car once a month (community service). But that’s the most I see happening with a plea bargain.

They would have had a plea agreement by now – if the prosecution is going that way. With the governments delay – it looks like that want a “slam dunk” (That’s a legal term) case.
The kid is an idiot, but he doesn’t deserve jail time. Slap him with a $25,000 fine and 2 years probation at most.
Obama won’t pardon him. Entering presidents don’t usually do that. Outgoing presidents give pardons and I highly doubt Bush will pardon him. Stranger things have happened though.

Out-going Presidents are generally lobbyed to deliver pardons, not just given freely. Last I looked, Bush will no longer be a White House occupant, neither in May ‘09 (as reported above) or in the rescheduled court calendar yet to be determined.
While not his wisest move on Earth, Yahoo should employ this kid (with thanks) for showing them what lax security measures they employ.
Since this kid has no record prior to this incident, he won’t see a $25k fine or jail time. A small fine plus court costs and community service is more likely. The kid is already weighted down with the legal fees he’s going to owe which will be taken into account in his sentencing.

I’m not so sure about the fine. The kid has rich parents, so he may see a higher fine than normal. Furthermore, if he had hacked Joe the Plumber’s (pun intended) e-mail, he may only see a small fine. However, He hacked a Vice Presidential candidate’s e-mail for the distinct purpose of trying to find information to smear her. That shows clear intent to commit the crime and will warrant a higher penalty.
That and if it has already reached this stage, that means preliminary discussions between the prosecution and defense have not gone so well. The prosecution may be after blood to set an example. It is a high profile case, and as such they would use it to show that “hacking” is a crime. Although he didn’t actually hack anything. More like social engineering and good luck with google.

The only “intent” shown was to fool Yahoo’s security childish email security and even on that point, you have nothing more than superficial media accounts to associate the kid to the “crime”. You’ve got nothing beyond that.
Furthermore, you’ll have to define “rich”, as in his parent’s net worth, _not_ assuming they are “rich” simply because his father is a TN state representative with an annual salary of what? $100-150k, if that? BFD.
Your further assumptions about communications between prosecution and defense are even more humorous, especially in light of your claims of having spent so much time before the bench. This “crime” was only recently committed and will likely take a year or more before it goes away in a puff of smoke, as it deserves. By that time, maybe your therapy may have gained some traction and you’ll be a happier person for the sake of those around you.
You guys have left out a very important factor it was done over the “air waves” which makes it a FCC violation which will make the fine even higher and also with the amaturish hacking appears to be pre-meditatied will increase the fine. (ie. if you use a radar jammer you can get a $250k fine)
the $100-150k is a base salary they make most of the money through lobbists.

The average salary for the Tennessee house of representatives is $55,000 plus a cost of living increase after every two year term. Plus any committees or chairs he holds which pay between $5,000 to $15,000 each.
Michael Kernell has been a State Rep since 1975 – that’s 16 general assembliess far. Say 3% for cost of living increase. So today he makes, $88,258 base salary. He holds 1 chair plus 4 committees. Lets say $15,000 for the chair position and $5,000 for each committee.
So his grand total is: $123,258.85 that’s a decent chunk of change. Besides – that doesn’t take into account investments, spouse’s employment, equity, other jobs like book deals and speaking engagements, kickbacks from lobbyists, general corruption payments, etc…
Also, I couldn’t find the exact cost of living increase rate and the exact pay per committee, so I went conservatively.
As far as the Defense talking to the Prosecution, that would start almost immediately. Irregardless of the court schedule, where everything takes a minimum of 30 days.
Lastly, what makes you think I’m angry about this what so ever? He is a kid that screwed up, give him a fine and probation and some community service and let him go.
