Class Action Lawsuit for Authorized Dealers
Against Sprint Nextel

I am one of the most well-known wireless leaders in Northern California providing wireless solutions for corporate accounts. The difference between my company and everyone else is my exceptional vision and leadership especially on the B2B side. Without sacrificing quality, integrity, and customer service, my abilities have gained me the knowledge and expertise to win numerous awards including top seller award for Northern California from a variety of wireless carriers. Having said that, I was approached by Nextel in 2002 to become one of their B2B Authorized Representatives as a result of my success from previous years. With my exceeding success through the B2B channel, Nextel approached me to do a joint venture on launching new retail locations in the Northern California market since there was no strong retail presence. With knowledge, experience, and expertise I put together one of the most dynamic teams of highly motivated and well qualified communication consultants. In 2003, my ex-colleague and dear friend was invited to join in this new vision. I launched eight locations in Northern California and I was invited to launch new locations in Arizona, Colorado, and Minnesota. In 2005, when the merger with Sprint occurred, the new management team: Mark Sadighian, Paul Harris, and Dennis McSweeney no longer shared the vision that Nextel had with my company. At the same time I found out that my partner was embezzling money and started a new wireless company with another carrier. When I approached Mark Sadighian with my new found news, the advise that I received was to separate our partnership and for me to start a new company under a new name. I was granted an exclusive dealer contract with Sprint/Nextel and their service center. Two months into my new company, I submitted six new retail locations that were denied to me for expansion, but at the same time were handed to someone else. Sprint/Nextel set me up for failure, after I invested hundred of thousands of dollars into the new company. Sprint/Nextel decided at that point not to support me in my visions, ideas, and ventures. As a result, I am seeking other dealers that have had a similar experience as me for a class action lawsuit. Before I posted my story online, I requested the immediate assistance from the CEO of Sprint, Daniel Hesse. He never responded to any of my emails, and at this point left me with no choice, but to put together a class action lawsuit for Authorized Dealers. I will not stop until my losses are compensated. If you are interested in contacting me with any questions, concerns, or to assist me in participating in this class action lawsuit please email me at: sprintactionlawsuit@gmail.com or visit www.nextel.bz

First off Sprints plans are the price that they are because of there "not so good" coverage. Yes they have coverage but in spotty areas and they don't have the fastest DATA network. That is the whole point of why Sprint's plans are ONLY $5 cheaper than Verizon. There unlimited talk and messaging is $20 cheaper. Save yourself the $20 and you'll see why it IS $20 cheaper...because your text message that you sent 20 minutes ago is just now being delivered. Secondly, Verizon doesn't use SIM cards for a million reasons but I'll just give a few. Yes, you can take out that SIM card and pop it into another phone and bam there you go...More like bam there goes your phone. Having a SIM carded phone makes it so easy for someone to come along and straight up steal your phone and you'll never ever ever get it back. With Verizon, if it gets stolen, you simply put it on a stolen report list with Customer Service and the next time someone goes into a store and tries and activate it, it will say it on the computer screen telling the Rep to take the phone from the customer and mail it to Verizon so that Verizon can mail it back to the person who put it on the stolen list. Now that LG Voyager that was stolen 3 weeks ago is now back in the hands of the person who bought it. Oh ya, all of your contacts that were on that SIM card are lost as well BUT with Verizon's BACKUP ASSISTANT App, all of your contacts will always be saved EVEN if your cell phone is sitting at the bottom of the ocean. AND most importantly, Verizon uses CDMA (Code Division Multiple Access) which gives Verizon the ability to pretty much give service to their customers almost anywhere, anywhere where Verizon offers coverage and not JUST coverage Im talking about LIVE MOBILE TV on your phone with channels like ESPN, COMEDY CENTRAL, FUEL TV, NBC, CBS, NICK, FNC, CNBC, MTV, MSNBC, FOX. NO streaming either, once its on your screen, its on with no buffering. Someone calls, cool, take the call and when your done, boom right back to your TV. Anyways, I can go on and on about why Verizon IS and WILL BE America's Most Reliable Network but the biggest thing is that Verizon actually does care about their customers and what their customers think. Sprint called over 1000 of their customers here in Texas and basically told them to take a hike. They payed for there ETF and allowed them to keep their cell number so long as they ported out to another carrier they would pay that $200 ETF. All because customers would call in and complain about there phone or their service and that is no joke, here is the website to prove it

www.gotapex.com/hardware/157089-sprint-releases-1-000-customers-for-complaining-too-much.html

Anyways, my point is (and no one will change my mind) is that Verizon IS the BEST and even better now that they have purchaed ALlTEL, and they only did that because they offer such a huge DATA coverage east and west parts of Texas and going west out towards California now making Verizon, atleast at the end of 08, America's largest cell phone carrier at just over 93 million. I don't want to get into AT&T but I will...They are no better than TMobile. I spit on the IPhone. That crappy piece of equipment is good for a paper wieght and thats it. Its half 3G and have lies. It's a 2G phone running on a 3G network, actually AT&T uses GSM/EDGE. EDGE is what the IPhone runs on about 70% of the time. The EDGE Network will only get 144 KBS at best, on a sunshiney day. Ask anyone who has an IPhone, how fast is it, what do you pay a month just to have it, how much did it cost AND MOST IMPORTANTLY do you have insurance on it. The IPhone is a nothing more than a fad that will take APPLE right out of the cell phone market...Leave the phone making up to someone who knows what the hell they're doing like LG or Samsung (not a fan of Motorola). Lg makes some amzing equipment from phones to washers and dryers. Those of you who do have the IPhone, Email me in a year when its broken and you're still in contract and I'll hook you up with a phone Verizon phone that's B.A. and reliable. I do work for Verizon, feel free to Email, no hate mail please, about anything regarding Verizon or any other carrier at

LOL...seriously?! You really want Sprint to go away? I understand that most of us who blog and pay attention to this stuff don't remember Ma Bell or think it was just a thing our grandparents cared about. Look up Monopoly or duopoloy and see what it does to an industry. The only reason we are we where are today is because of companies like Sprint who challenged the industry beheamoths and made them innovate and offer competitive pricing. If all we are left with is ATT and VZ, guess what happens to the cell industry. They stop caring! They'll keep prices high and agree to split the market then focus their energies on killing the cable companies. Wake up people! You need companies like Sprint.

@Edouble: how are you on a Simply EVERYTHING plan for $40. Sprint's pricing on that is $99 last I checked???? And it would be like changing from pride fighting or maybe Professional NFL ball to playing little league for VZ to offer something in the same "ballpark". Sorry if ysome folks just aren't serious about building their company for their agents, employees, customers, stockholders; just getting by with the minimum is fine for some, and that's great for those who so choose it.

@NB: Whahhh, whahh! Monopoly shmonopoly---ALLL companies have lived through the same time continuum all at the same time. Nobody gas had some mythical "unfair advantage over another. Cases-in-point:1)T-Mobile AKA Duetsche Telekom has had EXACTLY the same amount of time and has to work with EXACTLY the same municipalities/ Stae and Federal governing bodies/commissions/boards, etc., and yet their own board of directors has repeatedly CHOSEN to NOT buildout a U.S.A. 3G network. NOT MY PROBLEM!! 2)Sprint CHOSE to merge with a dying technology instead of competing with it, or waiting for the inevitable death or even a transition period during which they would be vunerable for attracting customers away from Nextel's PTT. 3)ATT has yet to catch up (even close)to VZW's 3G coverage, and VZW is already planning the demise of their current 3G in favor of their mind-blowing 4G! NOT MY PROBLEM! Yes, the I- phone is cool, go get an I-pod Touch and enjoy the freedom of about the same phone performance (yes, I'm aware of the lack of the gsm radio in the touch) w/o that pesky 2 year contract;-) You're acting paranoic, foolishly blaming the world's problems on the "big satan Verizon". What would YOU do if you were the big honcho in charge of a network, I ask? Charge juuuuust enough to get by, not making a profit and grow, to serve the customer better, so when a Katrina-size weather event or economic downturn occurs, your beloved public works project can then go into the toilet? What use is it if a company fails to continue to exist and be there to serve those customers? Better yet- how does that affect those who are/were employed by that enterprise?

@Don Louie: I guess you must have just showed up. This isn't the first rodeo for many of us who have suffered through either being a customer or employee/agent for ALL of the 1st tier, and some tier 2/3 carriers. I hate to be the one to break it to you, but having the same technology available to you and actually BEING equal are NOT the same by a longshot. When we had meetings at Sprint where I used to work, coverage was, and I quote "...NOT an issue- next question..." It's part of the Sprint culture, and they just can't seem to shake it off.Sad, when you think about it.
@theoutsider: I agree, they DID have the same opportunity that everyone else had- ESPECIALLY considering that they were awarded the first nationwide license. What a collossal feat of mismanagement (see above). I mean, if the thing in your hand doesn't work due to substandard network configuration, who cares how cool the phone is, or the ads for the company, or their services for that matter? (see Mark Said above-thanks Mark- well said)

@gog8rs: It would take a UF fanboy to say that you'd rather have a slightly cheaper rate for a substandard wobbly network than a reasonable rate for one that you can actually count on!
@MadMike:One upgrades a phone--on ANY NW--by simply changing to any new or used handset that operates on that NW-oh, does ATT actually charge you to do that?*snicker*. Simcards are:1)just 1 step away from the bag phone, 2)breakable (and 'zapp'-able), 3)make your precious handset VERY theft-prone!!...See, there are many reasons that simcards SUCK!! I bet you're one of those customers who have "been with (your service provider) for 20 years, thinks that all phones should be free- I mean after all, the big fat corporation will make it up in the end...blah blah blah". But wait, you've just received a free activation and free phone and free free free! And ummm, do YOU work for free and give away every single thing to YOUR customers? and if that's such a fantabulous idea, then why don't we all start giving everything away to everybody who wants it? Because then nobody would have any reason to do anything to better themselves, the company they work for, OR their customers. Sound fun?
@Dre, mykie, Jerry Marcus, G, crackberry718, and all those who hate VZW:Pls, don't ever fall for that lol, you are paying 99.00 for everything, (if it works, which it may or may not) And go to Verizon to pay 150 NOT 160! pls, You'd obviously rather have your tx/rx cheap and dirty, than have it reasonable and clean, nice try, but you wouldn't qualify to be a Verizon customer. Not everyone deserves to be one anyway. That's plain to see- otherwise, why in the world would T-mobile have ANY at all? BTW, the T-Mobile rep from across the hall just came over to get a Bluetooth headset for his new-ish Voyager *as drink goes through the readers' noses*. Hmmm...it speaks volumes that they are forcing him to get a T-slo phone for appearances. ;-]

@NB If I'm not mistaken AT&T and Verizon's current rate plans are the same... and they both charge $20 for unlimited txt msg'n.. OH OH WAIT a minute... What about their data? Oh ya, that's right.. VZW is a HELL of a lot cheaper. AT&T charges you $.01 for every KB and VZW charges $1.99 for every MB. Now let's do the math. 1024 KB = 1 MB... THAT MEANS that for every MB you use on AT&T's network, they are charging you $10.24 and VZW is only charging $1.99.... Now what were you saying?

Ya, that is all OLD news.. We've been doing the AT&T port-ins for months... And no matter what all of you say or how much you whine and complain and say that it is an old and used tactic, believe it or not, but MANY MANY ppl have taken advantage of both of those deals.. You wouldn't believe the amount of ppl pissed at AT&T or the ones that say Sprint "just isn't the same as it use to be"..

Josh, the numbers that are reported are net loss not gross loss. When the report says they lost 910k subscribers they mean 910k. Just like when the reports say VZW and ATT gained 1.1mil in the quarter, that is the number they gained after they subtract the number of deacts, thus Net Adds.

Has anyone tried VZW push to talk?? I have tried it and really like it, and everyone else i know that has it really likes it too. It works in many many places sprint nextel doesn't and it's just as fast on the new PTT network.

Verizon and Sprint do NOT have virtually the same network. Did you look at the recent JD Power reports?
The semi-annual study measures wireless call quality based on seven problem areas that impact overall carrier performance: dropped calls; static/interference; failed connection on the first try; voice distortion; echoes; no immediate voice mail notification; and no immediate text message notification. Call quality issues are measured as problems per 100 (PP100) calls, where a lower score reflects fewer problems and higher quality. (jdpower.com)

The only place Sprint/Nextel shows up in the southwest region and Verizon claims the top in 3 of the 6 regions where sprint only makes a showing in 1 regions......virtually the same??? come on.....

Yes Sprint has lost millions of customers. But the reporting is very skewed. The reporting always forgets to mention how many they signed up in a quarter. Sure it is not as many as they lost, but it closes the gap. I have had all of them, and last month I switched to Sprint, strictly for the $99 plan. As an unbiased report, so far so good. The most problems I ever had was with AT&T. I still dont know why anyone gets all up in arms about what carrier they use. Who cares. But Sprint is NOT going anywhere, Unless Purchased.

This is an OLD tactic - nothing new here. AT&T, MCI and Sprint used to do this back in the 90s to get Long Distance customers to switch. You people crack me up - yeah VZ sure came up with something new!!! Idiots

Please...The only prices Sprint is keeping in check is real estate around Kansas City.

If Sprint folds, the other carriers aren't going to raise their price.
Cincinnati Bell and Cricket would have more pull on "keeping prices" in check than Sprint would at this point in the game.

Sprint HAD the opportunity to be the best...Hell, at one point they WERE the best (as mentioned above, until about the late 90's).

As they say, the best advertisement is word of mouth advertising...it is also the advertising that will kill you the most.

Sprint has a 15 YEAR downward spiral, so of course people are going to lose faith in them and start bashing them. If shitty products and service didn't matter, then the Ford Pinto would still be adorning showroom floors to this day.

And don't blame Nextel for Sprint's current situation either. Sprint was already starting it's spiral before Nextel came into the picture. It's the fact that Sprint had the wrong Vision Plan (And yes...ALL PUN INTENDED) when taking over Nextel.

Ahh..Poor Sprint..You could have been one of the greatest. However, there's the big "IF".

Kind of like Mike Tyson. He could have been the greatest too...If....

So, maybe in some sick way, we keep Sprint around like we do Mike Tyson...To see what kind of dumbshit they are going to do to amuse us next.

Oh...And don't think I just hate Sprint. I hate all carriers. Sprint just happens to be at the top of my HitList right now.

That's all propaganda, both Sprint and vzw have the same network just about. All you that are hoping for yellow's demise are silly, Sprint, U.S. Cellular and Tmo are helping keeping prices in check if they fold all will feel it. The argument of paying more for better C.S. is dumb too because I pay to use my phone not talk to have a yes person and lately there have been a lot of one call resolutions. This is mostly directed at BGR and it's reporters refusal to have anything impartial about Sprint

Sprint isn't going anywhere? Then why are they hemorrhageing customers by the millions? Two million so far this year.

@ G:

Spring has the best date network? LOL Maybe back in 1999, but in that time the competitors have grown by leaps and bounds and Spring has just struggled to stay alive. If it weren't for their low pricing they would have even fewer customers.

Facts are facts, Verizon has the largest and most stable 3G network in north america. Their decision to only allow GPS through VZNavitator had nothing to do with fears about their network, it was a business decision. Just like not allowing the native AIM client on BB, but wait they just changed that.

Do we all forget that SPRINT lost 910,000 customers last quarter?

theousider you're funny as hell...and they are not offering if for Temporary MOBILE customers because it is just that, temporary...no one is concerned about them. No good phones really, no good service, no 3G...it's like they don't count. And the Android Dream doesn't count, neither does them starting to roll out their 3G service in some states years after everyone else is moving on to 4G. And I'll make a prediction now, Sprint won't be around for much longer. Why do you think they have the simply everything plan for $99 now. Before their prices were close to Verizon's but they're losing so many costumers so fast that they have to offer incentives. Is it me or does Verizon seem to be the only smart company in the cell phone business. AT&T and Iphone fanboys can say whatever they wan but at the end of the day their phones don't work and need a firmware update every 2 weeks just so it can break down again. You'd think biggest company, ie AT&T, would've come up with this, but no, again it's Verizon all over again.

I would gladly switch if Verizon just let me get the same pricing I get with Sprint after many years of negotiation - I'd have to start from scratch with Verizon. Let me switch and keep the same specs and pricing of my plan and I'll switch today! My contract has expired :)

Some of you are sooooo stupid. Oooohh $50, what about your cancelation fee, not to mention the cost of the new phone?

As for you Sprint haters, you have issues. Sprint has so many large contracts with the government, they aren't going anywhere.

They have the best data network out there period.

The $99 everything plan kicks everyone else's ass.

You want to know why verizon doesn't unlock their GPS, because they can't handle the data traffic.

verizon is scared, their PTT sucks, nuff said.

I am aware of that.
And for those who will read this post and wonder where they can get it at, let's make it simple for them:
http://softwarestore.sprint.com/wap/downloads/nfl09032008/app-prod-nfl-8330.jad

However, maybe I should have said "NASCAR Mobile" since we all know the hillbillys who actually use that service on their Sprint phones don't know how to use this here internet thingie.

Hence the reason why Tennessee, Alabama, Arkansas, Mississippi, Louisiana, Texas and Oklahoma aren't included.
