Apple Sued By Unhappy iPhone 3G User
Jessica Alena Smith, an unhappy iPhone 3G user from Alabama, is suing Apple for false advertising and for profiting from a defective product. Is she serious? While suing Apple is a little extreme, there’s definitely a growing sentiment that the iPhone 3G isn’t living up to the hype that all of those ads caused. Even after an update that was rumored to fix the 3G woes, the iPhone 3G seems to have gotten worse or remained the same according to most users. So, instead of finding the nearest forum or tech blog to whine about it, Smith went straight to court. Talk about being proactive! Is this what Apple needs to light a fire under its derriere so that they will stop pretending this is a small problem (2%, yeah right)?









And the sheep turns! Seriously though, why dont people just ask for a refund if they feel their device is faulty? If you were stupid enough to believe all the hype you only have yourself to blame, just suck it up or get a refund and stop trying to make a fast buck.

Because of how phone companies work. Even if Apple was willing to give her a refund on her IPhone, she is still stuck in contract with AT&T for another two years. So now you’re stuck in contract with either A) No Phone or B) A phone you didn’t originally want.

Good for you, Jessica! I returned the iPhone 3G after 2 days. Before buying it I checked the AT&T coverage maps and was supposed to get strong signals. That was not the case. I couldn’t get 3G at all. Companies like Apple and AT&T should be held accountable for deceptive advertising, wasting our money and in most of our cases, wasting a lot of our time.

Between this and the Nano battery issue, it seems Apple was in need of a good kick in the butt. Just because your silhouette commercials and white earbuds became bigger than Elvis doesn’t mean you get a pass for unsatisfactory work. IMO, the bar is set higher BECAUSE of success and Apple needs to start meeting and surpassing it.
And eat a protein bar, Jobs! You’re looking like a school girl.

Well, My Trans-atlantic business partner came off the phone from 02’s Business department, after being told He couldnt buy an iphone 3g on his business card in store at a CWP :@ So he called them up, and was told there is a 42,000 unit waiting list! Along with a 12-14 week delay for him to even to have one, but he (the corporate rep) also said there was no waiting list for the 8GB.
The guy believes that (Confirmed from higher up) apple, are delibratly holding off stock of the 16GB Due to a 16GB recall to be put into force some time soon…
So could this be true? Apple did the same with the first iphone, create stock shortages, boosts interest, and keeps a demand for the phone… but is this shortage really because of a product recall?

Am I the only one who has an iPhone 3G that is actually satisfied with it?
I barely ever drop calls, and usually when it happens it’s in spots where it happens with other phones I’ve had.
Surfing the web is fantastic. It gets email from three different accounts including one Microsoft Exchange server. I check my sports scores with SportsTap, I watch videos and listen to music all day with it at my desk.
This is probably one of the best phones I’ve had, if for no other reason I no longer have to carry two devices. I find myself using the iPod function way more than I did when I just had a standalone iPod.
I do realize that there are a few bugs (i.e. contacts run slow sometimes and the keyboard will lag occasionally) but it’s not a show stopper and compared to other phones, none do as much and some have more issues than the iPhone has (WM devices.. I’m looking in your direction…)

She should also sue ATT. Aple is not 100 percent to blame for this. ATT’s 3G network, yet being larger then lets say T-mobile is still not what it should be. Compaired to lets say Verizon or Sprint their 3G network is still very weak. ATT has been falsly advertising their 3G network for years often never telling customers how limited their 3G services would be.

Love them or hate them, Apple is here to stay. Being highly popular has it’s goods and bads. Every manufacturer has issues with some of its hardware and often its software. You don’t hear much about it because they may not be in the spotlight as much as Apple is. They did bring this on themselves. However, if you are an iPhone customer and you are unsatisfied, use the open window you are given (30 days) and return your device. If you decide to ride the early adopter glitches in hope that it will be fixed and will be the best device ever, then you are free to do the same. But who am I (or anyone for that matter) to criticize what people do with their money? If they want to buy an iPhone and suffer some glitches, then to each its own. I wouldn’t be caught dead with a blackberry (though the Bold is the only one that catches my attention). I like the Nokia E71, but that in itself had it’s problems. It’s a personal decision you make.
Let’s stop flaring people for their decisions and have meaningful comments on our personal choices. For all we know, you all married the fat chick in high school. And that’s cool, if that’s your preference.

Yeah I think like always the minority of the people are the most vocal. Most of the millions of people with the phone are not complaining, its just the loudest people are.
I think they do have software bugs to fix, but is it worth suing? no, US is way too litigious.
And ATT & Apple should have been smarter with the whole 3G Angle as ATT’s network is not large enough or good enough to sell to the whole country.

this is what gives lawyers a bad name. I suspect that she is somehow connected to a partner and this was something dreamed by the firm for publicity. Icould be wrong but I doubt it. Keep on the look out for any interviews on the matter by the plaintiffs.

When a company says it will be fast and better than the original and you have no reason to think otherwise then there is some sense of false advertising and being led to believe it was something that it is not. Its not the hype we were caught up with it was the promise of something that works as they advertise it to.

Remember the Motorola V710 recall a few years back? That was done only because unhappy users got together and opened a class action suit against Moto and Verizon.

I’ve used WM5 PocketPC, WM6 Standard, WM6 Pro, Good Mobile Messaging, and I’ve had exposure to BlackBerry. I’m an IT admin and we support Good Mobile and Blackberry for Domino users and WM ActiveSync for Exchange users.
All in all, the WM6 Pro with Exchange is the best E-Mail experience I’ve used. Good Mobile Messaging is terrible for way too many reasons to get into on here.
I’ve never been fond of BlackBerry devices, nor the user interface on the device so I’ve never had one in my pocket, however after setting them up for users it’s just never appealed to me.
The iPhone isn’t the BEST E-Mail experience, however it’s far from the worst. For keeping up with E-Mail and system alerts, and composing short replies when I’m out of the office it gets the job done. Coupled with the added bonus of not carrying a second device for my music and such it’s an easy win in my book.

blackberry isn’t designed for IT folks. It’s designed for corporate business folks who need an excellent email solution to stay connected.
I’ve used all three. I went from WM6 to blackberry, to iPhone, ditched the iPhone and am back with my blackberry. I’ll not settle for any thing else. I’ve learned my lesson.
I don’t give a rat’s ass how hard or easy to set up a device is. Out in the business world, the blackberry runs rough shod over everything else when it comes to email and communication.

lets break this down shall we…
1. what hype did apple make with their advertisements?! did you actually see an iPhone 3G commercial on TV because they were as primitive and lacking of information as possible. never did they claim that this phone was going to be perfect out of the box, never did they claim it to be the most amazing phone ever. they said it was INNOVATIVE… which it is! do we all agree?
2. directed towards JdSlim- sue ATT? have you even been reading all of the information and details out there because you’d know the issues occuring have NOTHING to do with ATT’s network what so ever. why would the iPhone suddenly show that their coverage isnt as up to par as they claim when all of their other phones (which are 3G btw) are working just fine in the areas they claim they will work as expected. as far as ATT goes, they hold no fault… if you actually read anything regarding the network you’d know that its caused by the chip that APPLE chose to use. chips are enhanced by SOFTWARE which APPLE is doing their very best to put out there for users
3. as far as being stuck to a contract. FALSE. if you dont like your phone then return it… nobody is forcing you to keep a phone you dont like or enjoy.

I agree with you 100%. For email, calendar, and other “Outlook” type apps, there is no equal to the ‘berry from a user’s perspective.
From the IT side, the BES and device config are a pain, but your users are going to get their mail. With WM 6, you really don’t need to do anything except configure access to your Exchange server and build a cab to config the device automatically. And then wait for the support calls to roll in.

i owned a blackberry for 4 years (8700, Pearl)
And i can say without a doubt, that they were buggy as shit just like any phone that has ever existed.
My pearl constantly crashed on me, the camera was sooo awful it might as well not been there, and surfing the web was like running through a dark hallway full of broken shards of glass….naked. It dropped calls, it erased my emails, texts, and BB messages. And it was soo cheaply built i thought i would break it constantly.
But that being said I still loved the phone though, because it COULD do a lot of things.
I know have the iphone, and it has it bugs- but it still does a lot of things better than any other device I have owned.
And for all those BB fanboys, yes i dont have push and yes i dont have BB messenger. But the threaded texting and the way it handles gmail imaping makes me very very happy.

This is so damn annoying! People knew how the 1st generation iPhone launch was like and all the software issues people dealt with yet people still went out and bought the phone the day it was released…retarded!! Some people just never learn from other peoples mistakes.
I’m glad I didn’t buy this iPhone, I’ll wait for the 3rd gen, maybe even 4th. That’s how I went with my iPod purchases and have been very happy with my 5.5gen iPod. Hopefully the 3rd/4th gen iPhone will have a lot more storage to accommodate my music repository.
