iTunes 7.4.1 shows up, adds ringtone ability

Well…Apple is still making steps towards the things that people wish the iPhone would’ve come up with at launch. Yesterday, iTunes 7.4.1 became available for download, and not only adds ringtone creation, but also adds sync ability with the new versions of iPod (new Nano, Classic, and Touch).  This does undo the previous trick of adding your own ringtones, but if you are that disappointed, there is a fix for even this new version. Here’s the full scoop:

With iTunes 7.4, sync your favorite music and more with the new iPod nano (third generation), iPod classic, and iPod touch, plus create custom ringtones exclusively for iPhone with many of your favorite songs purchased from the iTunes Store. You can now also play purchased videos with closed captioning (when available), easily rate your favorite albums from one to five stars, and watch videos at a larger size inside the iTunes window.

    no the iphone update is not out yet. They said it would be by the end of the month. this was just an iTunes update.

    they dont own the rights to the songs, they dont make the choice on charging you for the ring-tones, the record companies do.

    Just to clear things up.

    Having to pay for ringtones is a choice from apple, has nothing to do with record companies (the right holders) or copyright legislation.

    When you legally own a song and move it to your cellphone setting the phone to use such file for incoming calls does not require additional rights.
    Trust me I am an IP lawyer.

    Ringles are a pricing scheme apple chooses to adopt, and that is enforce because Apple controls the hardware (aka iPhone); record companies could NEVER force this on Apple or consumers beacuse it would have no foothold in copyright law. For this same reason the iTunes 7.4 which allowed users to make their own ring tones was not infringing any copyright at all.

    Sorry to brake the Apple Fanclub bubble…but you are getting ripped off.

    They explain the situation better than I. Apple is not right but they are not solely to blame as you naive apple bashers would make people think.

    That is EXACTLY what i said in my first post.

    So COME AGAIN pls? I will say it once again, record companies have NO possible way to stop you from using music you legally own as a ringtone.

    Apple on the other hand CAN, because they can lock the hardware in such way. Of course if Apple decides to sell ringtones, they have to give money to the right holders.

    The logic here is that Apple sells ringtones THEREFORE they need contracts with record comapanies.

    If Apple allowed people to use their music as ringtones record companies could not say a thing about it; the minute Apple decide to make EXTRA money ripping consumers off on rintones…then the record companies get their cut as well.

    Its what you make the ringtone from that matter. Ituunes contracts with labels require additonal fees.
    The articles says if you rips music from CDs or othe non Itunes stuff then its all OK. Thats the difference.

    Your wrong about the money factor, Apple could not do it for free as the article says. They cannot do any rintone without charging.

    I will try one more time explaining it to you, I believe in good faith I am not getting my point across.

    Option #1
    (This is the business model ALL the phone manufaturers adopt)
    -Manufacturer makes a CellPhone

    -They make the device so that the user can use any sound file they legally own as a ringtone.

    -The consumer uses what ever legal sound source he wants and makes his ringtones.

    -CellManufacturer does not make extra money from ringtones.

    Option #2
    (Apple business model)
    -Apple makes the iPhone

    -The iPhone is designed so that for custom ringtones the consumer can only use specific files that ONLY Apple sells.

    -Apple sells ringtones for X ammount of money. The record companies decide their cut on each song sold as a ring tone.

    Now Apple adopted option #2, they locked the iPhone and decided that consumers would have to buy ringtones from them if they wanted to use custom songs. Of course record companies make money on top of that.

    All the other phone manufactures say “if you own a song…then use it as a ringtone all you want”.

    How can you say that Apple is not ripping you off???!!! You do realize that NO OTHER cell manufacturer locks the consumer on the ringtone issue???!!! ALL the other cell manufacturers allow you to make your own ringtones…it’s a standard; any mp3 I have loaded on my Nokia E90 I can use as a ringtone. Apple blocks that option and you people say “oh it’s the record comapanies fault”.

    The issue is not about Apple chargin X or Y for ringtones. It’s the fact that on an iPhone you can’t use your own MP3s as a ringtone even though there is no legal obstacle; you buy a song from Apple…and they don’t let you use it as a ringtone on an iPhone….but you can take that SAME song and use it as a ringtone on a Nokia.

    HENCE you are getting ripped off.

    Incorrect. No one is getting ripped off. Wanna know why? Because adults have the ability to choose whether or not to purchase a given device or service. If you find it’s important enough to use different MP3’s, then you pay the price.

    I’m so tired of people whining about being ripped off as though it’s some right to own these devices and use these services. Grow up already.

    What you are not getting-
    Apple has contracts with the Record Labels. In those contracts they set how those songs can be used. If used in other ways other than the ipod use then it requires other forms of payment. Apple then is required by these companies to make sure that if a song is being used as a ringtone then it must be compensated by the end user.
    This is why their is only 500K songs that Apple can now use as ringtones as the others, they do not have rights or ability contractually to see or give away as ringtones. Its intelectual property.

    Apple as the #1 onling music retailer has to maintain its good staning with labels and due to the volume of sales they are watched by the labels. If Nokia begins moving millions of songs through their online retail site then they will be forced to use the same structure. Also, I doubt legally that any phone manufacturer says “If you own it then use it as a ringtone”. Go ahead and prove me wrong, but it entirely depends on their media rights contract if they have a music store.

    I agree with your message that we shouldnt have to pay for ringtones but you blaming apple is only half the story. Apple as I have said is not in a position to say OK your whatever you want for your ringtones.

    And again, you griping about this is getting old, just stay with your E90 (good phone) if this bothers you soo much.
