Cell phone lemon law in the works

A law that would allow subscribers to get out of their mobile contracts without penalty has been passed by the Illinois State House. The law allows for consumers to sever their contracts without an ETF if they’ve experienced handset troubles on "more than three occasions." Similar to other so-called "lemon-laws", the bill is designed to protect consumers from having to pay for services that they are not able to use due to manufacturer or service provider defect. The bill still has to pass the state Senate, and will have no immediate implications for consumers outside of Illinois. At the very least it’s a testament to the fact that legislators are finally standing up to the over-oppressive nature of most cellular contracts.

Wow, this law makes no sense. Since when are cell phone providers responsible for manufacturing cell phones? They have little to nothing to do with making the phones, so why should the providers be punished for shitty job that Motorola, Nokia, Palm, etc do in making their phones? The only valid reason for getting out of a cell phone contract is service issues with the carrier. That would make sense. Getting out a contract because the phone that a service provider had no hand in making does not make sense. Essentially this law is saying guild by associate is OK.

I am currently batteling with Alltel on a LG Scoop. I have already been through 3 of them in 5 months and keep having the same problem. These people are unbelieveable.
The cellphone provided shouldn’t be responsible, but it will make cellphone makes from forcing “refurbished” cell phones on people already having problems.
Do you return a defective item at Best Buy and get a refurbished one to replace it? I think not.
best buy on replaces items in store for 30 days just like the cell phone companies. after that 30 period if you did not purchase the Best Buy warranty they refer you to the manufacure of the item you bought from them.
