Cingular/AT&T Responds To Class Action Suit

Do you feel like Cingular’s service quality has fallen significantly since their merger with AT&T? You’re not alone. A class-action lawsuit was filed in 2004 in a Seattle district court, alleging that former AT&T customers who didn’t transfer service to the big Orange experienced terrible call quality and spotty service. This may all be a bit of a moot point by now, but Cingular/AT&T issued a written rebuttal last week, maintaining that the suit was "completely without merit" and are moving for a dismissal of charges. If the case does, in fact, proceed, it could have significant ramifications for cell contracts as a whole, agreements that are notoriously limiting for consumers.

    I have been battling it out with AT&T regarding their poor service, frequent dropped calls,etc. It’s not just my phone, it’s my daughter, my two sons, my daughter-in-law AND my husband’s company cell phone! I have jumped through hoops,doing what they asked me to do…turn off my phone for 30-60 sec. to “re-boot”, I have done it all. I have honored my contract with them, I pay my bill in full and on time so they do not have a gripe with me. I have honored my contract and thus AT&T is in breach of the contract!! If they do not let me out of my contract without penalty, we will probably bite the bullet and pay the early termination fee. My fear is they will come back with some sort of,”oh yeah, you owe us this fee because we are full of ourselves.” If a class action lawsuit comes up or if one is in action, if it’s not too late, I want to sign on. “Strength in numbers”, as they say.

    I couldn’t agree more! I have three separate lines purchased through Cingular; after the AT&T take over my service is remarkably worse! I used to brag about Cingular’s service, I now warn people about AT&T’s false claims of
    “least dropped calls, clear service.” I know of at least eight other people who have made similar reports of poor sevice after the AT&T take over. I’d like to sign on to the lawsuit! Please let me know if this is possible.

    I signed up for Cingular services back in May of 2007 and had I knew then that it would be taken over by AT&T I would never had signed up, I dropped them from my home phone years ago, however since the take over to AT&T I have found charges on my phone that i know should not be there, they changed my service with out my permission costing me numerious fees to correct ( activating the internet on my childrens phones with out my consent ). I can not wait for my contract to end so once agian i can end another bad relationship with AT&T

    Cingular is the only provider I have had. Quality was pretty good until the merger/takeover by AT&T. Service quality has declined since then. I have more dropped calls and poorer quality calls than before. Our family upgraded our SIMS cars and phone hoping for some improvement but nothing has improved and we are locked into a contract for another 2 years. Customers service could give a rat’s behind about the crappy service. I am counting the days until I can move on without paying early termination fees on 4 phones.

    JUST GOT OFF THE PHONE WITH ATT “CUSTOMER SERVICE”… IT TURNS OUT I CANCELLED MY SERVICE
    AFTER 23 MONTHS INSTEAD OF 24 AND THEY WANT TO JAM ME WITH EARLY TERMINATION TIMES THREE.. NEVER MIND THAT I HAVE CALLED THEM OVER AND OVER AND OVER ABOUT NO SERVICE, DROPPED CALLS, “MORE BARS IN MORE PLACES” .. WHAT A JOKE
    I NEVER SIGNED UP WITH ATT… WAS WITH CINGULAR AND WAS SWITCHED. I WOULD LOVE TO JOIN A CLASS ACTION, PLEASE.

    Help since att xingular merger, THey switched my plan without even asking me or telling me, then the last two month my bill has jumped from 200. to 600 and this month 1800. for three phones only used for emergency wich there hasnt been any.On my bill summary they are charging me .35 min for every call regardless of my plan or mins rolled over.
    Wish I knew how to join the lawsuit here in texas

    In Janurary I told the costmer service I’d pay my bill of $108.07 monday to keep my service
    from getting disconneted.I took the monies to
    a cashland. Well the next thing I know my I receieve a overdraft from my bank in the amount of $257.97 the full amout owe on my att
    account. My house payment bounced. I asked them
    to return my monies they told me It would take
    two weeks. Mean while my house payment has late and I has to come up with $214.97 to make the house payment and pay the overdraft on my
    account for $26.97. although I use a cell phone
    that doesn’t even work. The only way I can get
    a new phone from att is pay $50.00 or sign new
    contract. Thanks ! for nothing I have one year
    left on this contract. For all this they tell me you don’t have to pay again until Feb. Well
    it was time. Jan. Feb. I guess they think the
    overdraft. and housepayment late fee. didn’t
    matter.

    I contacted AT&T directly and asked for the Premier sales dept. The salesperson identified himself to be in the Premier dept. and call offer better company deals. He offered me a Blackberry 8310 for $199 with a mail-in rebate for $200 only available to Premier members. In addition, my bill would only go up $15 a month for the data plan. He stated that I would be receiving my mail-in rebate in 3-4 weeks. I got the phone a few days later withough any data plan, so I contacted AT&T who informed me that I did not purchase it. In addition, the salesman who sold me the phone was not a Premier sales man. The floor manager stated that there was NO mail-in rebate for $200 as well and apologized for the miscommunication. In addition, the notes entered in by the AT&T sales rep. did not indicate any rebate or data plan for an additional $15 on my bill. Good thing I contacted AT&T or I would have been stuck with a bill for $199 and a contract for 2 years without a data plan unless I wanted to pay an additional $69.

    By the way, their customer service is horrible. I was tranferred to at least 5 people to find out what was going on. In fact, one person even told me that a rebate was on its way. It took me over two hours to find out that I was deceived.

    I am greatful that there is a law suit! I started with AT&T and had fulfilled my 2 year contract and continued service. When I started with AT&T they gave me a TDMA phone. When Cingular took over they started charing me fees that I had not been charged before. My favorite fee…System Upgrade fee of $7.95/Mo.
    Then a new fee popped up as they were discontinuing the TDMA service. So there was another 4.95/mo fee. I called and said that I was not responsible for the System Upgrade fee if I was not USING that system because my phone was TDMA. Well…that went nowhere. But boy were they willing to make me sign a 2 year contract. So I asked them to if I could just pay for a CDMA phone and swith from TDMA to CDMA and they said “No” you have to sign a 2 year contract. I felt like a hostage!!!! Money Grubbing Buggers!!!! So I went to T-Mobile got a better plan and saved $17.00 a month. Funny..AT&T sends me post cards asking me to join AT&T. I just toss them. iPhone or not.. I will never use AT&T wireless. I am researchign this suit so I can join.

    I left AT&T years ago for Cingular’s cell service and have been HUGELY HAPPY with Cingular… until the AT&T merger. AT&T has absolutely ruined Cingular’s quality and reliability. Billing is wrong… voice mails take DAYS to show up on my phone now – used to be minutes… Noisy reception – dropped calls – exploitive changes in charging schemes, service “not available” messages, etc. The worst cellular service I have ever seen, and I’ve had many indeed. I will be leaving for a another provider. I have had ENOUGH.

    To date I have had no communication on the status of my participation of a class action suit against Cingular Wireless. I am looking for an update on this case to ensure that is is going forward.

    I, too, left AT&T for Cingular in 1999. And was VERY pleased with Cingular’s service for all the years I was with them. Now, it is a nightmare. Billing problems (new fees), service problems, failed calls with 5 bars, voice mail when it shouldn’t go to voice mail… horrible. Absolutely the worst I have ever seen in all the years I have had cellular service. Also, I have had no communication regarding the suit. This site is the first I have heard of it. I would LOVE to be diposed for this suit.

    I left AT&T after Cingular merged with them due to excessive loss of service quality and went to Verizon. Yes, they always had more bars, but the quality was exceedingly poor with frequent audio dropouts even when signal level was high (4-5 bars even). I called AT&T multiple times, even talked to the 3rd and 4th tier technicians, being more technical myself then anyone below them.

    If you want to experience a real nightmare, got with their U-verse service, get the billing combined with wireless, internet, phone, and go paperless statements with autopay.

    Then, try to change something. What a CF!

    I left AT&T after they charged me for call I did not receive or make. They stated that because I was in a roving zone overseas. I have to pay for message left on my phone. The contract fine print says that even if you d not make or receive cal you a liable for roaming charges left on voice mail. I specifically asked the question to AT & T prior to my trip and they told I would not be charged as long I did not actually make or receive any calls. AT & T is a deceptive company and new law needs to be introduced to stop the monopoly this company. I will never use any AT & T service again and plan letting everyone know that AT & T has and endorses deceptive practices and hiders behind legal jargon that the average person would not understand until it’s too late. I have not paid the bill and thank god my contract was over. I will take this to court even if I lose it will bring national attention to this companies bad behavior
