Cingular/AT&T Responds To Class Action Suit
Do you feel like Cingular’s service quality has fallen significantly since their merger with AT&T? You’re not alone. A class-action lawsuit was filed in 2004 in a Seattle district court, alleging that former AT&T customers who didn’t transfer service to the big Orange experienced terrible call quality and spotty service. This may all be a bit of a moot point by now, but Cingular/AT&T issued a written rebuttal last week, maintaining that the suit was "completely without merit" and are moving for a dismissal of charges. If the case does, in fact, proceed, it could have significant ramifications for cell contracts as a whole, agreements that are notoriously limiting for consumers.

I have had Cingular for about 3 years with actually no problems. I keep my bill current. 2 months ago my bill had questionable charges and options I didn’t ask for. I am still trying to get them corrected. AT&T sucked in the past and still sucks. I have 4 lines and will wait patiently until the plans end and will drop them as fast as a dropped call. I am so disappointed.
since ive gotten att&t,,, ive had more dropped calls, i have to go outside my home ,just to recieve or get good phone reception.. this stinks. since i pay 120.00$ a month and cant even back out of a contract i made with some other company.i do belive , we all have been bambuzuled.
My service declined. I hate AT&T!!!
In 1992 I signed on with Cellular One which was subsequently merged/bought by McCaw Communications, Inc. which was subsequently merged/bought by AT&T which subsequently spun off Cingular Wireless and is now back to AT&T.
Since this last reincarnation my service has been the absolute worst (in all respects) of anytime in the ~15 years I’ve had a cell phone.
I am an old att customer who did not switch when the cingular buy out happened as cingular would not offer me the same plan but my understanding is they are charging me an extra 5/00 per month because i did not switch. customer service treats the old att customers lousy and offer little help if any.If they want old customers to switch they need some type of an incentive as in any buy ouy.
True suffering w/ CINGULAR! All you need is HAWK ELECTRONICS enter your life. And the rub is YOU ‘are the problem’. once you ‘move your service FROM CINGULAR to HAWK ELECTRONICS’ then you understand ALICE IN WONDERLAND. Nothing makes sense, you try to sign in to you (10 yr.) CINGULAR account and it doesn’t ‘know’ you. Next, good old CINGULAR refers YOUR good, long time, and big $$ account to a COLLECTION AGENCY! (did I see a large worm w/ a hooka or was that a new BlackJack phone he was smoking?) I called CINGULAR they could not, would not, discuss MY LONG TERM account, bill per/mo around
$512.00! With me! WHAT’UP! So I call HAWK ELECTRONIC they too can’t discuss MY ACCOUNT W/ ME! I could go ON about this screwing. LIKE last week I payed ‘my bill’ @ HAWK ELECTRONICS w/ check. COOL, but hold on, I then payed an additional FIVE DOLLAR chg. WHY YOU ASK? Because I payed in PERSON! (And I wanted personal service. What was I thinking.)
HAVE OTHER USERS OF THIS SITE EXPERIENCED SITUATIONS LIKE THIS? HAWK ELECTRONICS.
‘go ask ALICE,( an employee of choose one.. ATT or CINGULAR or HAWK ELECTRONICS) when you bill is TEN PAGES TALL.’
my service was wonderful until just recently when my phone went from saying cingular to saying AT&T on the phone itself then low and behold service sucks.I had AT&T years ago and it was terrible so I switched to Cingular got service everywhere. This is just terrible I get so frustrated I just want to scream. I until 3 weeks ago got service in my house now I have to go outside what is that crap.
If you were charged on your cell phone bill for ringtones or other mobile content that you never authorized and/or you were sent unsolicited SMS text messages and you want to fight back against these companies, get in touch with some class action attorneys.
These fellows are investigating unauthorized cell phone charges and wireless SMS text spam and might be able to help you:

Oh my god!!! And I thought it was only me that was dealing with the “Call Failed:” on my phone with EVERY call I try to make. I have been Cingular for 5 years now, this was and still is the first cell number I have every had! I have not once, had a dropped call or ever been in one area in this whole bay area where I could not get service……..until about 4 weeks ago! From one day to the next, my phone became useless!! Every call that I make, a have to “retry” at least 6 time before it will go through. I feel like “Call Failed;” is my new screensaver on my phone. I can stand in one place and watch my bars go from 4 bars to none, and back and forth. If I find a small area that I have full bars, as soon as I press the send button, my bars disappear. I get service pretty much nowhere now! I have lost many potential clients, because of never even knowing they had called until days later. When I finally was able to call customer service and ask about the problem, they said you need a new phone, which I almost went ahead and bought, until my sister said, she was having the same problems too! And also, my phone is like new still, because I take very good care of it! Now I find this sea of people all with the same complaint……..I’m not crazy!!
Boy did you touch a sore point with me. Those bastards are wicked, corporate suit mongers with eyes on another monopoly. I want them out of my house and out of my life. When I moved to Florida last year and Bell South was Bell South and Cingular was Cingular,I had no problems. Then Bell South joined with Cingular and gave us a deal to unite our services so we would only have one bill and it was $41.00 a month. Four months late,we are in the whole for $2,000 because nobody told us we had 200 minutes per month to talk for free. I get more talk time on my cell. My mom is 82 and getting frail, they shut her phone off,I went and got a GO phone only because my best friend has cingular in NJ and its the only we can talk for four hours. But the down time and dropped calls get so frustrating that after an hour, we can’t stand it anymore. I called their home office in Fort Worth and they sent me four razer phones, why? I don’t know, I sent them back when I realized it was going to cost me $329 dollars a piece. All I wanted to do was complain about the dropped calls. I’d like to see Bush and AT&T go at the same time, right to jail. I’m so sick of both of them I can’t stand it anymore. Ask me why one is just like the other and think of the service you get at the price you have to pay and you’ll understand what I’m saying. They both got to go, how do we get rid of them. They are like roaches, they keep having babies and before long, they’ll have everything Cable has. That can’t be allowed to happen, they must be stopped. Them and Verizon up north. They have land rights to NY,NJ,CT and that area. The only way out of it is cable unless some wonderful person came along and came up with a third alternative, which is not Vonage. So now you see, not only are there people who would support a class action suit, they would support a whole hearted takeover by Cingular itself. Power to the MASSES who hate AT&T.
so where is the lawyer?? Someone find a good lawyer!!
I will join this lawsuit. I will testify that I needed 911 and my call was dropped resulting in me getting assaulted by a stranger!
SOMEONE TELL US WHERE TO FIND AN ATTORNEY THAT ISN’T AN OPPORTUNISTIC CROOK!
A7 seems to know a good deal about Cingular/AT&T, and I have a problem with the last few months of their billing to me, which ran $1600/$1550/$3500/$2000, because two of our phones were traveling in Mexico/Honduras/Barbados and Italy/Greece/Turkey at per minute rates of up to $2.99 for voice and some other obscene number for text messages. Is there any way to fight these rates, or are we just stuck with them?
I too am very angry with ATT/Cingular. They are too big to respond to their customers. No excuses!!!! I am paying for a service that I am not receiving. I WILL join the lawsuit because that is the only language that big corps understand. Maybe they will wake up!

i’ve been a custumer for years, but i’ve never expierienced just sloppy customer service until Cingular merged with AT&T.
they don’t have enough operators, they close early, don’t have any weekend service & are quite rude !
In my last bill,I just found that there was hidden lost distance charges, though we have nationwide & we were calling in our area code. They said it was in the fine print, that you must dial a 1- before the number. (We’ve never done that before.)
i insisted to spead to a supervisor, but they were insistuous that they could handle my complaint, i finally said I WANT TO SPEAK TO YOUR SUPERVISOR, & NOW, & they said “she would have someone call me back.” it’s been weeks, & no one has called, nor will they.
They don’t care about us , they have the world by the string, now, & who cares what we think.
How do i let my voice be heard? & who is the “Boy Genius”??
Maybe he can get there attention. I’m seriously thinking of switching all my business, cell, internet,& direct tv. to another carrier.!
I have been a Cingular customer for 5 years and ever since the merge my cell phone service has been horrible. I couldn’t hold call for more than 2 min. 44 seconds at a time. I called and called them until finally I told them that they were in breach of contract and I was going to terminate the contract (I had names and ID numbers and a long list of each call and responses) and I was going to call the Attorney General they gave me to their IT team who has since fixed the problem. Everyone in my family who had Cingular had the same problem and have all since gotten the situation fixed by saying the same thing. What the heck happened to Cingular?
Please tell me how to do what you did. I am an “old original” AT&T wireless customer. I want to get a new phone and they are trying to force me to switch to the “new” service. My original AT&T plan in $49 for two phones with 700 minutes. They want me to pay $69 for two phones with only 450 minutes.
How do I find a new phone that will work on the old AT&T network?
Please help.
Magna,
You might try getting a phone elsewhere (e.g., EBay) and then paying 50.00 or less to get it unlocked- look on Google for someone in your area who can unlock phones.
At&T has a NASTY customer service, they lie and mislead people to tricky telephone service and plans. They don’t even respond to the BBB. I will be very pleased with this company get well sued.
I’ve been treated like a dog by the customer service, I got overcharged for something that I’ve never ordered. While I was disputing the charges, I got the telephone cut off, which was later CHARGED me to be restored. No matter how many times I tell them that I was mislead in their services, they keep saying that, all the charges were right. Nasty customer service, all the way. If anyone knows a good lawyer, I would like to sue them in a good amount of money to justify the months and stress that I been through. Someone please, take down this horrible company, now !
I have been with AT&T – Cingular – NEW AT&T (Which ever name they choose this week) for over 10 years. I have 5 phones on the Nation-wide Family Plan. Last week I got a letter from NEW AT&T stating they were thinking of terminating our contract, because less than 50% of the calls on 1 of the phones are being placed outside our “Home Network” service area. I work out of state, about 10 months a year. This is why I got the cell phones in the first place.
The phone that brought this up is my Sons, a US Marine, working in CA. If anyone knows of something I can do, Pleas let me know…
Dann
I am so disgusted with the new at&t phones.
In Aug.07, I and my husband upgraded our phones for 2 years and I am so sorry I could cry. We depend on our phones for health reasoned emergencies.
Since the new phones, that came from Walmart in NJ, where we thought was very conveinent to upgrade at the first AT&T phones were returned to the store after a week, dropped calls constantly, dropped connectios, bad reception, and when you spoke to someone the voices sounded shaky, like the connection was about to abort. SO we went back and both got another version of the LG series, my husbands phone passes to a point that he keep it. But mine was worse than the first. It was too late to return to Walmart since they go by the first phone date.
I had to go to AT&T and they agreed to sent me a replacement pone of same type, but may be either a new or reconditioned one. When I got my phone it was new, but their rule is I MUST take what they send me. Needless to say unless I purchase another phone must take my chances for the next to years with a USED phone! Something is wrong with this.
My phones from 1995 till now were never a problem with cingular or Nokia (which I thought were good phones).
I am extremely!!! disgusted and with health problems at the root of needing the phones, don’t know what else to do. I am am not rich and cannot afford to just go out and spend more and more money on something that I have already purchased, and now stuck with for the next two years.
Please will someone publish the CLASS ACTION SUITE I heard about on CNN!
